MINI One gearbox failure

I bought a second hand MINI One with a full service history from a local dealer. It had 52k on the clock and was five years old. After eight weeks I returned the car with gearbox problems. The dealer claims this is 'wear and tear' and says I have to pay. Is this right? What recourse do I have?
