Remote tailgate problem with 307SW

I have bought an 05 Peugeot 307 SW xsi and the tailgate is not unlocking or allowing the remote locking of the Car, Panel message states the boot is open. Is this a common problem specific to 307s that is relativley fixable or should I look to claim on the warranty?
